Daily Trail Release & Waiver of Liability & Indemnity Agreement

Sorry to slow the fun by making you wade through legal-ese, but when you get to an ORC-sponsored event, you'll be asked to sign the following release waiver. I'm sad that we can't take personal responsibility for granted, but in this increasingly litigious society, I think a disclaimer is a necessary precaution. It should also remind us that this is serious business and that we all have to be responsible for our own actions. If you need a spotter on a trail, ASK. If you feel uncomfortable spotting for someone else, SAY SO. Open communication is the only way to have a safe, fun event where everyone can learn.

Above all, we want to have fun and enjoy our hobby. If we keep that in mind, we won't have any problems. The trails we are on may range from 2WD high clearance roads to extreme trails that *will* likely cause damage. Work with your trail leader to ensure that your skills and your vehicle are up to the trail you have chosen. Communicate!

By completing this form I hereby apply to Off-Road.com. (hereinafter 'ORC') to participate in the 4-Wheel drive event indicated below. By my signature below, I certify that I have read, understand and accept the following representation, stipulations, and waiver. I further understand that ORC; property owners, or lessees will not accept financial or legal liability for any injury or occurrence arising from ORC activities and that accordingly, my participation in such activities must be at my own risk. I understand that my operation of a motor vehicle in this event subjects me to all laws and requirements respecting operation of a motor vehicle, and I agree to abide by all applicable laws, including:

  • The law that the vehicle be insured in an amount not less than the statutory minimum.
  • The laws against the operation of a vehicle while under the influence of alcohol or drugs.
  • The laws that all persons operating vehicle be properly licensed to operate said vehicle. The laws that all persons must wear their respective seat belt. I agree to abide by all additional rules established by ORC or the trail leader
Accordingly, I hereby waive, for myself, my personal representatives, heirs and next of kin, all claims which I might have against ORC; property owners, or lessees, and any of them in combinations, and their officers, directors, agents, employees or contractors for injury, accident, illness, property damage, death or other occurrence arising in any manner whatsoever out of my participation in activities sponsored by ORC. I expressly assume all risks of my participation, including the risk that I might be injured as a result of the negligence or gross negligence of ORC, property owners, or lessees, and any of them in combinations, and their officers, directors, agents, employees or contractors.

I expressly assume financial and/or legal liability for all risks of injury to persons who accompany me on ORC activities, including family members, guests, friends and acquaintances, and all other persons who accompany me in my registered vehicle. Furthermore, I agree to indemnify, save and hold harmless ORC from any and all losses, costs, damages, expenses and attorney's fees arising out of my participation or the participation of persons who accompany me in ORC related activities.

WAIVER MUST BE SIGNED BY ALL DRIVERS & PASSENGERS (for any participant under the age of majority, a parent, the minor's legal guardian, or adult responsible for the minors must sign this release form and write the word "MINOR" and their age next to the minor's name)
